I find the Hate Crime Bill in Scotland rather worrying. It expands the concept of a hate crime from an individual or group intent on causing hate to one that simply is seen to be so by those who complain. In other words intent is irrelevant. Potentially it opens up any perceived 'hateful' comment to be a criminal offence, including those in an artistic context. It seems to be taking the line of certain disputes of recent times that those offended are what matters, not what might actually be meant by a comment. Till now this has led to some quite severe consequences for people who said things perceived to be bad (such as losing a job) but now it will be criminal, in Scotland, if the bill becomes law. The idea that no-one has a right not to be offended, in law, is set to change.
